What does the Compulsory Motor Insurance Act cover in case of an accident?
By law, every type of car and motorcycle is required to have compulsory third-party motor insurance, officially known as the "Act for the Protection of Motor Accident Victims" or **"Por Ror Bor."**
This insurance protects anyone who is in a car accident, including drivers, passengers, and pedestrians, in the event of injury, disability, dismemberment, or death.
**Coverage under this Act is for medical expenses or funeral costs, as applicable, but it does not include compensation for property damage.**

Initial Compensation
This compensation is provided without waiting for a determination of fault.
- For injuries: A maximum of **30,000 Baht** for actual medical expenses.
- For death, dismemberment, or permanent disability: An initial payment of **35,000 Baht**.
- For death after receiving medical treatment: A maximum of **30,000 Baht** for actual medical expenses, plus **35,000 Baht** for funeral costs, for a total not exceeding **65,000 Baht**.

Indemnity
This is the compensation received by the not-at-fault party after a determination of fault has been made.
- For medical expenses: A maximum of **80,000 Baht** for actual medical expenses.
- For permanent dismemberment/disability or total permanent disability: Compensation ranging from **200,000 - 500,000 Baht** (compensation for dismemberment is subject to the terms of the insurance policy).
- For death: **500,000 Baht** in compensation.
- For inpatient care: A daily allowance of **200 Baht**, for a maximum of 20 days.
How to Claim Compensation
The motor accident victim or their heir can submit a claim for medical expenses personally, or they can grant authority to the hospital to receive the payment on their behalf.
The initial compensation for medical expenses, up to 30,000 Baht, can be claimed within 7 days from the date of the request to the insurance company, **without waiting for a determination of fault.** The period to claim Por Ror Bor benefits is within 180 days after the date of the accident.
Required Documents
- A copy of the national ID cards of the accident victim and the vehicle owner.
- A copy of the accident victim's house registration.
- A copy of the police daily report.
- A copy of the vehicle's registration book.
- The insurance policy schedule.
- Hospital receipts and a medical certificate.
In the case of the following motor vehicle accidents:
- Hit-and-run.
- The vehicle has no insurance and the owner refuses to pay.
- The vehicle was stolen or robbed.
- There is no identified owner of the vehicle and the vehicle has no insurance.
- The insurance company refuses to pay or pays an incomplete amount.
In the cases mentioned above, the victim can claim **initial compensation of 30,000 Baht per person** from the Motor Accident Victims Fund, located at the provincial commercial office in every province.
